Fan Parts Limited Warranty

Limited Warranty on Fan Units. SonicAire warrants that for a period of one (1) year from the date of shipment of a fan unit (the “Warranty Period”), such fan unit will be free from material defects in material and workmanship, as determined by SonicAire in its reasonable judgment. EXCEPT FOR THE WARRANTY SET FORTH IN THE PRECEDING SENTENCE, SONICAIRE MAKES NO WARRANTY WHATSOEVER WITH RESPECT TO THE FAN UNITS, INCLUDING ANY (A) WARRANTY OF MERCHANTABILITY; (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; OR (C) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE. This limited warranty is provided to the original end user of the fan unit and does not extend to any subsequent owner or other transferee.

Extended Warranty (Installation Services). Customers who elect any SonicAire-performed installation service (Bronze, Silver, Gold, or Platinum) receive an extended Warranty Period of two (2) years from the date of commissioning (as documented in the signed SonicAire Commissioning & Startup Report). In addition, SonicAire warrants its installation workmanship against defects for a period of thirty (30) days from the date of commissioning. All other warranty terms, conditions, and exclusions set forth herein remain in full effect.

Extended Warranty (Preventive Maintenance Program). Customers enrolled in the Installation Plus preventive maintenance program receive an annual renewal of parts and labor warranty coverage, including normal wear and tear on mechanical and electrical components (as determined by SonicAire in its reasonable discretion) and up to one (1) service trip per year. Warranty coverage continues for the duration of active enrollment and, if renewed without lapse, provides lifetime parts warranty coverage. Any lapse in enrollment terminates the extended warranty, and re-enrollment shall not restore prior coverage or restart the lifetime warranty benefit. SonicAire reserves the right to modify program terms, pricing, and eligibility requirements at any time. Contact SonicAire for program details and eligibility.

Replacement Parts. SonicAire replacement parts purchased as standalone items carry a ninety (90) day warranty from the date of shipment. Replacement parts shipped as part of a warranty repair carry a one (1) year warranty from the date of shipment.

Remedies. During the Warranty Period, SonicAire will provide replacement parts and factory labor to correct defects in materials or workmanship that existed when the fan unit was purchased, or at its sole discretion, replace the unit. SonicAire may require the return of defective parts or units for inspection as a condition of warranty service. THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND SONICAIRE’S ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. SONICAIRE’S LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE FAN UNIT, NOR SHALL SONICAIRE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES OR LOSSES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, OR BUSINESS INTERRUPTION, WHETHER DIRECT OR INDIRECT.
